A U.S. District Court Judge has ruled that the unique design of the Powers Fasteners Trak-It magazine strip of 10 pins used in gas-fired fastening systems does not infringe upon ITW patents.
The announcement was made by Powers President Jeffrey R. Powers.
In the ruling, Judge James B. Moran of the U.S. District Court Northern District of Illinois Eastern Division granted Powers Fasteners, Inc.'s motion for a summary judgment on Oct. 7, 2003, and stated, "In short, we conclude that the defendant (Powers) effectively designed around the (ITW) patent by a structure that is substantially different..."
